Terms of Service

Mindmarvel is a web service that generates, slices, and packages themed UI asset packs and hero-section reference images from text prompts. The service is accessible at mindmarvel.ai and is operated by Sontiac LLC ("Mindmarvel," "we," "us").

By creating an account or subscribing, you agree to these Terms. If you don't agree, don't use the service.

You need an email-addressable account to use Mindmarvel. You're responsible for keeping your password private. Share your login at your own risk.

You must be at least 13 years old (16 in the European Economic Area). If you're using Mindmarvel on behalf of a company, you represent that you have authority to bind that company to these Terms.

We offer two subscription tiers, billed monthly in advance through Stripe:

• Indie — $19/month, 15 pack generations per billing period.
• Studio — $59/month, 60 pack generations per billing period, plus a commercial-use license file.

Subscriptions renew automatically at the end of each billing period until you cancel. We may change prices with at least 30 days' notice; any change takes effect at your next renewal.

Credits reset at the start of each billing period and do not roll over. Unused credits at the end of a period are forfeited.

Upgrades today: if you upgrade mid-period via the "Upgrade Today" option, we charge you the full upgraded price immediately, reset your billing cycle, and give you the new tier's credits on top of any unused credits from your old tier.

Upgrades at next period: no charge today; the upgrade takes effect at your next renewal.

Downgrades: take effect at the end of your current billing period. You keep access to your current tier (and any remaining credits) through the end of the period.

Cancellation: cancel at any time through the billing portal. Your plan remains active through the end of your current billing period.

We don't offer refunds for unused credits, partial months, or unused generation capacity. If we've billed you by mistake (duplicate charge, billing error), email us and we'll make it right.

This policy may not apply where prohibited by local consumer law — if you're in the EU/UK or another region with statutory refund rights, those rights override this section.

You own the images, assets, and files produced for you by Mindmarvel, subject to the terms of our underlying model providers (currently OpenAI and Google). Our providers grant broad usage rights, but not exclusive rights — identical or similar outputs could in theory be generated for other users.

Commercial use:

• Indie tier: use in personal projects, internal tools, and commercial products, subject to the "Acceptable Use" section below.
• Studio tier: all of the above, plus a written commercial-use license file included in each pack for distribution or resale of products that incorporate the assets.

You may not resell the raw generated asset files themselves as if they were your own design work (e.g. flipping packs on stock-asset marketplaces).

Don't use Mindmarvel to:

• Generate content that is illegal, defamatory, harassing, or sexually explicit material involving minors
• Generate content that infringes someone else's copyright, trademark, or right of publicity
• Generate deceptive content intended to impersonate a real person or brand
• Attempt to reverse-engineer, scrape, or overload the service
• Circumvent rate limits, credit allocations, or authentication

We may suspend or terminate accounts that violate this section, without refund.

Your prompts and generated images are sent to our underlying model providers (OpenAI, Google) for processing. We may retain prompts, outputs, and usage metadata to operate and improve the service. We do not sell your data to third parties. See our Privacy Policy for details.

Mindmarvel relies on Stripe for payments, OpenAI and Google for image generation, and third-party cloud infrastructure for hosting. Your use of Mindmarvel is also subject to those providers' terms. We're not liable for third-party service outages, pricing changes, or policy changes.

Mindmarvel is provided "as is" and "as available." We make no warranties, express or implied, about the service's availability, fitness for a particular purpose, or the accuracy, quality, or uniqueness of generated content. AI output is probabilistic — you are responsible for reviewing generated assets before using them commercially.

To the fullest extent permitted by law, Mindmarvel's total liability for any claim arising out of these Terms or your use of the service is limited to the greater of $100 or the subscription fees you paid to Mindmarvel in the 12 months preceding the event giving rise to the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or substitute service costs.

You can cancel your subscription or delete your account at any time. We can suspend or terminate your access for breach of these Terms or for any conduct we reasonably believe is harmful to Mindmarvel or other users. On termination, your right to use the service ends, but payment obligations for the current billing period remain.

We may update these Terms from time to time. For material changes, we'll give at least 30 days' notice by email or in-app banner. Continued use of the service after the effective date means you accept the updated Terms.

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Sarasota County, Florida, and you consent to personal jurisdiction there.
